One place is the Starbucks there, but you'll need to wait if you want to sit by the window.

At first,
you can look down Hachi-kou crossing at the overpass
between Shibuya MarkCity (Shibuya station on Inogashira line)
and Tokyu Toyoko store (Shibuya station on JR/Ginza lines) that is up-side of Hachi-ko statue.
There is free to walk.(^-^)

Starbucks prohibits photography from their 2nd story window. They usually have a staff member there to ask people not to take pictures.

Can confirm StarBucks at Shibuya strickly prohibits photography of the crossing! Despite having bought food/drinks for the whole family and all sitting at the window overlooking the crossing, the second I lifted my camera to take a photo I was swifty stopped by a Starbucks employee! They are right on to it.

It has been a few years since I've been there, but I think the overpass on the 2nd floor isn't great for photography as the glass is safety glass (thick, not very clear, and loaded with wires at short intervals).

The best place to look at shibuya crossing is from... The shibuya crossing. Wandering in the crossing and seeing it getting empty to give way to cars and afterwards back to pedestrians is the best way!

The Ginza crossing is pretty nifty too. You can Google photos.

Why Starbucks prohibits taking photos?

It's not perfect, but you can manage to take photos from the overpass without making the wires too obvious. I sat my camera on the window ledge with the lens touching the glass. I then framed each shot such that that centre of the image was unobstructed, had the crossing as the focal point and ended up with an image that had subtle lines where the wires were.

Good luck!

That must be a new rule in Starbucks then. When I last went there in 2008 it was not a problem taking photos from up there!

In 2005 it was a no-no. I just put my camera on the counter and while I was sipping coffee I just snapped a few, but then I was told not to do it again.

I visited that overpass to look down Hachi-kou crossing last week.
It's not so bad!
There are 2F and 3F and it's full-glass-sided toward that crossing.
Although I'm unsure about camera, photograph and so on.
