Small taxis seat four passengers. Large taxis usually seat five passengers. Large taxis are less numerous than small taxis. So, if you use three small taxis, you will fit 12 people. If you use three large taxis, you can fit 15 people. Unless the children are very small, they will have to use a seat on their own.

Do you mean that if the child is small it is not against the law if the small taxi chose to accommodate 5?

a person who is more than 12 years old is one.
a child who is until 12 years old is counted as two-thirds (0.6666,,)
11 + 2x(0.6666..)= 12.333... round up to 13.
in your case, there is no difference between adult and child.
if you use 3 of 5 riding capacity(including a driver) cars, the maximal number is 4x3 = 12 passengers.

how do you bring your luggage ?

Chew
Define 'small"
Ultimately it's the (small) taxi driver who decides whether to accept the 5th passenger.
If he says NO, what can you do?
No stranger on this forum can answer that Q at all.

Yet Another, I am only asking if it is against the law and regulation for a 5th passenger in a small taxi.

Yes, it is against the rule, and I would expect taxi drivers to abide to the rule. Otherwise, they could be in big trouble.

"Small" = 小型

I've been in regular taxis with 5 people that included children before. The children were toddlers. I wouldn't expect this flexibility if children were much older esp. if the adults were large by Japanese standards.
