Fired employer - what to do 2015/8/2 16:58
Hi

I am from India and I got 3 years work visa on engineer/spl humanities quota..

I came to Japan last week and worked in visa sponser company after 5 days work he suddenly told me that please leave the company as my performance is not enough but it's not the main reason as he cannot judge me in 5 days ( he took me to develop new division and he has very small company so he might not have budget or some other reason)

I shocked for this reason and I came out of the company by pay only 5 days salary

Now my question is how many days we need to inform to immigration and how long we can stay at japan to find job ? What profs we have to show that I am searching for job ?

Any major change in circumstances needs to be reported within 14 day. The employer might report the change too.

Please look at your employment contract - doesn't it say anything about cancelling the contract (from the employer side) and that they have to give a certain period for notification? They should not be just allowed to cut you off, and that's it. Are they paying you to fly into/out of Japan?

Usually "a few months" - maybe 2 to 3 months or so - you should be OK, but hearing that you've worked only for 5 days, the immigration authorities might reach some other conclusion.

As the prevous poster wrote, you must notify Immigration within 14 days of the termination of your contract.

There is a chance that this will raise some suspicion that you obtained your visa fraudulently (and then nobody know what will happen...), but assuming it doesn't, you can stay in Japan for at least three months (from the day your contract was terminated). If you still have not found a new job after three months, Immigration may start the procedure to revoke your status (I do not know how systematically they actually do it). You are under no obligation to search for a new job, and even if you do, it would probably not help your case if they decide to revoke your status before you have found one.

Thanks for your comments..

in the contract he just mentioned that

On the termination of the appointment or either party giving notice to terminated the appointment.( he didnt mentioned any date)

when i ask for reason he said they can fire employee with 14 days of working with out notice.

he gave me the contract of joining date with June but i received visa in July 2015 and started working in july..i asked him to provide new contract he said ok but before this he did..


i have one offer from india but they dont have office in japan..is this acceptable ?

once we find new job what documents from new company has to submit to immigration.

i find one offer from Indian company and they have only represent office in Tokyo and not registered in Tokyo.

immigration will consider this kind of offer ?

Are you going to be doing work for that representative office in Tokyo as an "engineer" or any task that fall within the classification of "engineer"? Usually I don't think a "representative office" can engage in commercial activities.

The office in Tokyo cannot "hire" you locally, if they are not a corporate entity in Japan, I think? And in that case, the only resident status/visa classification that would apply would be "inter-company transferee," for that you need to be hired by the Indian entity, and got sent to Japan.


About your first employer in Japan:
Since you could work only starting with the time when you got the visa, they must start counting from July, when you actually started working.

my visa comes under engineer/Spl in Humanities and International Services.

They have only represent office..they asked me to do Makret Research about their future expansion..for this job i have to market research and some times to meet potential clients in japan.

i worked earlier with this company in India as a consultant.

will not consider ?

For my 1st company :

i came to japan in 15th july and started working from 21st to 27th july.

OK, it sounds like there is some validity in what you can do for that representative office.

Ask them if the representative office in Tokyo can hire you directly, to pay you, etc. If that is possible, and your responsibilities seem to fall under "specialist in humanities and international services," so if you get them to employ you, "maybe" all you need to do is report the change of your employer.

However, if they cannot hire you, this will be a status change from your current one to "inter-company transferee," and requires involvement of the company back in India.

they gave me 1 year contract and like to extend..

one self employed guy in tokyo acting as representing for that company apart from that they dont have bank account in tokyo or registered in tokyo.

If they are able to offer you a contract, then it should be fine. And market research activities fall within "specialist in humanities/international services."

You might want to consult an immigration lawyer to be sure.

P. S.

I hope that one "self-employed guy in Tokyo" has a proper "office" in Tokyo. For someone to be recognized as a "representative office" and hire people, a proper office seems to be required.

thanks for the reply..i am not sure about that office..when i talk with them they have representative office and one self employee support them.

they give one year contract for me so i am thinking immigration can accept or not ?

i heard they will give me 3 months chance to find new job ? is that true or they give less time ?
