Visa Renewal and quit work 2018/4/16 15:43
Hello together,
I have been living in Japan for 4.5 years and I currently got the Engineer/Specialist in Humanities/International Services visa. I just applied for another extension today.
At the same time, there are some severe problems at my current work place and I want to quit work as soon as possible. I have already a new place to go, but they are not able to take me in until July (but they will 100%).
Will I have any problems if I quit work the moment I got my new visa (i should have 3 month after that until I need to get a new job, right?)

I hope, someone can help me there.

According to what I heard is that, the company can inform Immigration who will revoke the visa status.
I have not experienced this personally but this is what I learnt from my company's Admin branch (when I inquired about the instance that I am transferred to another country/overseas branch)

Therefore I strongly advice you not to do so (as you intend and explained in your question) since you will face trouble in re-applying for the new job in July. To my personnel experience, the company fills out the necessary form and gives us the supporting documents for visa application and it is our sole responsibility in obtaining visa. I had a clause saying that the contract will be terminated/not be awarded if I fail to gain the employment visa myself.

In fact one could argue that the application you filed today was fraudulent, since by filing it you stated an intent to continue working for your current employer, while here you state that you intend to quit as soon as possible.

Yes, there is the three-month "grace period", but that's assuming you are honest and not trying to game the system. If immigration thinks you are being deceitful, they can revoke your status (or worse) at any time.

Thank you for your opinions.

Actually, my old visa was ok July anyway, so theoretically I would not have had any problems without applying for my new visa since I would have gotten another Job (same work, so no visa change) within 3 months & before my visa expires.
My current company just wanted me to renew my old visa as soon as I can do it, because the person in charge will not have time to care too much about me and my paperwork for a while. (another reason why I want to quit)
Now I am here, having applied for an extension, but wanting to change my job....
Do you think, there will be less problems, if I stayed for another month after I got my new visa? Or maybe get my new company to hire me earlier?

What do people normally do, when change of job and visa expiration come at the same time?
Would it be maybe better if, as soon as I get my new visa, I explain my situation (including already 99% having a new job)?
I really have no intention of fraud or anything, I don't plan on staying in Japan on a working visa longer than 3 months without being employed. Situation just kind of makes me crazy...

So you have already applied (at the current employer's request) for the renewal, intending to work for the current employer, and then things get bad, let's say, so that you think of changing employers, and you find one that can take you in, but starting in July, when your work-permitting resident status will have been renewed. If things happened that way, nothing fraudulent about it.

Still, since you are renewing the resident status with the current employer, if you quit that job the moment you get the extension, which by the way both your employer and you are obligated to report to the immigration authorities, that would be a red flag for the immigration authorities, that they might look into it (not immediately proceed to revoke it, by the way, it is just that when immigration finds something suspicious, they "might" provoke it).

If I were in your shoes, after I get the renewal, I would suck it up and continue to work with the current employer until the new place is able to take me in, at least when they are able and willing to put down their name as your sponsor.
