Can my japanese step-father adopt me? 2019/6/8 21:21
So my step-father wants to adopt me so that I could have his surname and can get his inheritance when the time comes but when I checked the adoption process in Japan I do not belong in any of the options there. My mom and my step-father have been married for 6 years already. I would also add that Ifm a filipino citizen but I am half japanese. I havenft met my biological father tho nor I have any idea where he is. Also, if it happens to be that I can be adopted, would that make me a japanese citizen if it gets approved? Or would I still be filipino citizen?

Your current age help get you some answers also.

Current laws only allow adoption up to 6 years of ages.

The laws are changing for the ages to be lifted to 14.

Ages 15-17 has a limited process with crevats attached.

Sorry I dont have any more info other than what google can find.

Thank you for answering. I am currently 18 and turning 19 in June 16. I have read some adult adoption but none of it matches my case.

I think your window has closed being an adult now.

Dad is dad, no matter what your surname is.

As for inheritance. I'm pretty sure that is legal will related. Not legal surname related. But could be very different in Japan compared to rest of the world though.

You can be adopted and be recognized by your step father. But you cannot apply for a visa since you or an adult.

Formerly, childrenfs ties to their biological parents could only be cut before the age of 6, but under the revised law children 14 and younger are now eligible.

Children aged 15 to 17 can also be subject to the special program if they lived with their prospective adoptive parents before the age of 15 and agree to be adopted.

Your step father can apply a process by family court in Japan.
the so called Adoption Decree.

You can discuss your options with an immigration lawyer.

But it is not an easy process and it will take time before your will have an answer.

Japan has two adoption systems,
which are fundamentally different
: the normal adoption and the Special Adoption.

The normal adoption can work for you and your step-father.

One significant difference between the two adoption systems
is in whether the child remains as a legal child of his/her natural parents.

Formerly, childrenfs ties to their biological parents could only be cut before the age of 6, but under the revised law children 14 and younger are now eligible.

The both are partly incorrect.

Currently
the revision of the Civil Code for the changes in the Special Adoption system
is just after the legislation by the Diet,
has not yet even been promulgated;
it will come into effect within one year from the date of the promulgation.

In the present Special Adoption system,
there is exception of the age limitation on the child for a specific case.

Special Adoption is to be established by a ruling of Family Court
when there are special circumstances,
in need for the interests of the child.
Even if you were young enough,
as long as your legal mother can care for you sufficiently,
you would not be adopted by the way of Special Adoption.

Special Adoption is to extinguish the legal relationship between the child and his/her natural relatives.

Normal adoption has no legal effect on the child's status as a child of his/her natural parents.
A person adopted by the way of normal adoption
may have a duty to support both his/her natural parent(s) and his/her adoptive parent(s).

Your step-father,
with the consent both of you and of his legal wife who is your biological mother,
can voluntarily adopt you by the way of normal adoption.
It goes without Family Court's permission.

No; adoption does not bring you Japanese nationality.

your mother was a Filipino national
and your biological father was a Japanese national;
is that correct?

Were your mother and any male person legally married at the time of your birth?
If they were, was that male partner of hers your biological father?

Yes, my mother was a filipino national at the time of my birth and my father was a japanese citizen. But the thing is after my birth my father went back to japan and never came back. Since then, my parents have never contacted each other. I would want to claim my rights to be japanese citizen since i plan on living here until my time comes but it seems to be very difficult process to do so or almost impossible. Im still young and I know how difficult it is or rather complicated to apply for a job when you are a foreigner so as much as possible i would want to change my nationality now.

Also yes, my mother and father were married at the time of my birth but divorced after he left.
