Part time foreigner no paid holiday? 2019/12/19 16:40
Hi, I work part time in large fast food chain. I have a Japanese spouse Visa. I work there now for about 10 months, 5 times a week for 8 hours a day. All my Japanese colleagues have more than 10 paid holidays, but I have 0. I searched and read that I've enough working hours to qualify for 10 days of paid holiday. I work directly at the company. I've been told by the store manager that maybe because I'm a foreigner these rules don't apply to me and I don't qualify therefore for paid holiday. Is that true?

That is definitely not true. Common rules apply regardless of nationality if you work under the same employment contract/format. Once you’ve worked for 6 months, and you have not missed work day/hour, you should be eligible.

I'm a foreigner these rules don't apply to me and I don't qualify therefore for paid holiday.
Not true. Show him link especially on Article 39 or refer to labor office, not hellowork.

Because you are a foreigner is not true and you should check this with HR department.
You started 10 months ago and often you get your paid holidays after completing one year or 6 months.
You should receive a list with the correct paid holidays ratio to your contract.

Even if you have paid holidays, it is frowned upon to use them.
With the new law demanding 5 off days per year, our management is having us take the days off but work from home.

No company really care about the labor office. Not like they can do anything other than a 500k fine.

I cannot found myself in this story.
I am working for a Japanese company, I get 10 days after first year and additional 1 day extra every year.
I can use all the holiday (company is pushing) and if not I bring the left overs to next year.

So there are companies which are following the rules.

it is a typical example, so called as 類は友を呼ぶ.
when you are a good person, you are hired by a good company. (your coworker and friends are a good person.)
when you are not a good person, you will be hired by a non-good company.
