After 2 kids, almost 5years married and almost 8years together we both want different things now.

We both reside in Japan, my wife is Japanese im Australian but i want to stay near my kids.
I can permanently stay in Japan correct?

Though we need to divorce in both countries right?

And we both one day want to remarry (not each other) when the time is right, i assumed she asked as she wants stability but was unsure on timeframes for this?
It doesnt bother me that she wants to remarry just wasnt sure you could do so quick

Sorry to hear of your situation.
Whether you can stay depends on what resident status you have: Spouse of Japanese - no. Permanent Resident - yes.
If you are a holder of Spouse of Japanese status, and you get divorced (then you lose the basis for your residency here), and if you can establish that you need to be in Japan in order to provide for your children, you could apply for Long-term Resident status to stay.

By what countryfs law did you get married?
If you got married by the Australian law (and reported it after-the-fact to the Japanese authorities), youfd need to resolve that Australian marriage accordingly.
If you got married by the Japanese law, then youfd need to resolve it accordingly.

The only restriction that applies to Japanese women is that she cannot remarry within 100 days from a divorce, just so as to ascertain the babyfs father (outdated law, we know, but thatfs what it is still today).

Marriage is not a child game.You married for some days ,then divorce, then re married ,then divorce. You know that our creator believe in institution of marriage. So discuss problem with your partner then try to solve.
If your child found their parents are separate ,then it effect them seriously,they bear this
trauma whole life.

I don't think you will automatically be allowed to stay in Japan permanently unless you hold a PR. You need to meet requirements for a new resident status, and requirements are depending on which one you apply.

If custody is required, search how it is granted. I heard many fathers can't have it in Japan.

After Divorce, you will lose your residence status.so For your betterment, Discuss the problem with your spouse.
