Child custody if both parents have passed 2023/9/28 18:52
Hi there, I'm not a Japanese person. I'm just wondering, if in a scenerio:

a child (around 16 years old), was to lose both of his parents and doesn't have any relatives or acquaintances to take care of him, will he be sent to a(n) foster home/orphanage? Or is he allowed to live on his own?

I'm sorry if my question seems silly. And if anyone wonders; No, I am not a 16-year-old-boy, my question was merely based on my curiosity. Thank you in advance.

family court decides what is the best for children (what is beneficial for children).
when children are older than 15, the court respects children's will.

As suggested, a 16-year-old in Japan is free to live on his own, but since he's a minor, he would need some kind of a lawful guardian anyway. Otherwise, he would have trouble earning money or education.

Or he can be sent to a foster home /orphanage which is often a home for about a dozen children per a pair of foster parents. Then he needs to move out when he becomes 18.

But then, it's also possible for teenagers to hide from the law.
