Child of Japanese national visa 2024/11/21 18:36
I am inquiring on behalf of my 36 year old son who would like to live and work in Japan but assumes it is not possible.

I am an Australian citizen and my sonfs father was a Japanese national that I met whilst working in Japan. When I was pregnant I felt insecure financially and in our relationship in Japan so I returned to Australia for the birth. I kept in touch with the father and although he personally acknowledged responsibility he chose not to be on the Australian birth certificate and I assume my son wasnft entered into his family register.

My son and I returned to Japan when he was a baby but his father didnft want to meet him and I was advised by a lawyer to not pursue the matter.

Since then we have visited Japan many times a tourists and my son finally met his father when he was 18 and again at 21 but they havenft been in touch sincec for 15 years.

I discovered recently that he should be eligible for a spouse child of Japanese national visa. Is that the case?

If so, we have friends in Japan that would be happy go guarantor. Would his biological father have to be involved? Also, would it be best to apply when he is in Japan or in Australia?

1.chose not to be on the Australian birth certificate and I assume my son wasnft entered into his family register.
2. Would his biological father have to be involved ?

1. what proof ? as in black and white do you/son have to show that Japanese heritage come into play?
verbal acknowledgement don't hold any ground to Immigration.

2. Of course, because he is the only proof/connection you/son have to Japanese thingy.

Consult immigration lawyer.

the relation must be proved by koseki. therefore, probably impossible.

of course, you (and your son) can sue a biological father to recognize your son as his child at family court in Japan. if you win, your son will be recorded as his son in his(the father's) koseki. as you may know or not, the registration in koseki means the child has an legal right to inherit some inheritance. therefore, when he has a family in Japan at present, it introduces serious problems to his family.

to work in Japan, it is easy when he has BS degree or an equivalent.

- Your son doesnft have Japanese nationality by birth because (even though one parent is Japanese) the parents were not married at the time of birth and the Japanese parent didnft take the procedure to recognize the child as his before birth.

- Child of Japanese national visa: I thought this was available only up to age 18, and also the intent is to allow the child to live in Japan with the parentc in any case, not having proof would pose difficulty.

There is no age limit for the child visa.
He has to prove that he actually is a child of a Japanese national, so he needs his father's help.

It sounds like the father is the irresponsible type. I hope your son luck.

Sorry, my mistake. There is no age limit for gchild of Japanese nationalh visa.

To apply for this, though your son would need some official document/proof that he is indeed a child of Japanese - either on his gkosekih (family register) in Japan on on birth certificate in your country.

Thanks to those of you who responded to my message.
Itfs frustrating, Ifm getting lots of conflicting answers. Ifve tried contacting a few immigration lawyers but so far they havenft replied. The only proof I have are my private diary entries from around when my son was born and his Ancestry DNA results and I donft think they would be acceptable.

You need the legal family paperwork from within Japan.

No confusion. You don't have this as the father or you didn't do it when he was born.

Done...
