hi!
my friend is now working on a working holiday visa in japan and he had some trouble with his employer. he had a car accident and is willing to pay for the damage.
but know he got a letter from his boss and the boss says, that he wants to fire him. my friend is living in an appartment of the company and in the letter is written, that he has to leave in 2 days from now.
is this legal to kick somebody out like this?
has anybody of you some knowledge about the japanese law in such a case?

Before someone more in the know gives an answer, I think you'd need to give more info.

I get the feeling I need to read between the lines to guess that your friend has really, really upset the boss big time, hence angry boss demands rapid vacating of the apartment.

Your friend is 'willing to pay the damage', so again I'm guessing he's responsible for crashing the company car, or some similar action against the boss/company.

Apologies if I'm off the mark, but you certainly need to fill in some gaps before sound advice can come your way.

Oh, sorry - I read too quickly, you do say it's because of the car thing.

I still think there must be a bit more for the boss to want your friend out in only 2 days.

Otherwise of course, 2 days is just plain ridiculous.

well, I am not supposed to tell the whole story...

and yes, he was responsible for the car accident, and therefore he also pays for it (of course).
but it seems quite unfair, that he gets an email in the morning, which says he is fired and that he has to leave the appartment in just 2 days!

Well, I'm assuming he was driving while under the influence of alcohol, and if this is the case then it wasn't unreasonable nor atypical that he was fired. And if his apartment was a perk of the job, then out he goes.

If your friend has broken the law then he can be dismissed without notice, and any perks of the job (i.e. the apartment) would go along with that. If he hasn't broken the law then it could be a different story- what does his contract say?

I don't see how you can expect us to give an accurate answer if you don't give us all the pertinent information.

I doubt it's lawful for a landlord to give a tenant a two-day eviction notice. Even if it is the company's apartment I don't think they can do that.

Call the Japan Legal Support Center at 0570-078374. They have English-speaking operators.

Free law consulting in foreign languages are often available at your local city hall or ward office. If he is having trouble finding one, tell us roughly where he lives, and someone may be able to find a website.

and no, he has not broken the law by driving drunk. he tried to not crash into a dog and then there was the sidewalk...

but thanks again. we did not know about the support hotline. he is living close to tokyo, so we would not have problems to find something suitable.
and thanks to sakura house (I hate spam, but know its worth it) he also had found a new room.
